This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit or make a purchase from www.vertigohome.us (the “Site”), create or access a customer account, communicate with us, sign up for marketing, request a return or warranty service, or otherwise interact with Vertigo Home.
Our online store is powered by Shopify. As a result, certain information may be collected and processed by Shopify and other service providers that help us operate our business and provide our services.
By using our Site or providing personal information to us, you acknowledge the practices described in this Privacy Policy.
1. Personal Information We Collect
The personal information we collect depends on how you interact with Vertigo Home.
Contact and Identification Information
We may collect information such as your name, email address, telephone number, billing address, shipping address, and other contact information you provide to us.
Order and Transaction Information
When you make or attempt to make a purchase, we may collect information relating to your order, including products purchased, order value, billing and shipping information, order history, discounts, returns, refunds, cancellations, store credits, gift cards, warranty claims, and communications relating to your order.
Payment Information
Payments made through our Site are processed through Shopify and/or authorized payment providers.
Payment providers may collect payment card numbers, bank information, billing information, and other information necessary to process your transaction. Vertigo Home generally receives transaction information and limited payment details rather than your complete payment card information.
Customer Account Information
If you use a Vertigo Home customer account, we collect information necessary to identify your account and associate it with your orders and activity.
Our current customer account system may authenticate customers using a verification code sent by email rather than requiring customers to create a traditional password.
Customer Service and Communications
We collect information you provide when you contact us by email, through the Site, or through another communication method. This can include questions about products, orders, shipping, returns, cancellations, warranty claims, damaged merchandise, Special Orders, or other customer service matters.
If you submit photographs, documents, receipts, or other materials as part of a warranty, damage, return, or customer service request, we may retain those materials as part of our records relating to the request.
Website and Device Information
When you visit our Site, information may be collected automatically through cookies, pixels, log files, and similar technologies.
This information may include your IP address, browser type, device type, operating system, referring website, pages viewed, products viewed, searches, items added to a cart, checkout activity, date and time of visits, interactions with the Site, cookie identifiers, and approximate location derived from information such as your IP address.
Marketing Information
If you sign up to receive marketing communications, we may collect your email address, telephone number where applicable, marketing preferences, and information about your interaction with our communications.
2. Sources of Personal Information
We may collect personal information directly from you when you make a purchase, create or access an account, submit a form, contact us, subscribe to marketing, or otherwise provide information to us.
We may also collect information automatically when you use our Site through cookies, pixels, analytics tools, and similar technologies.
We may receive information from Shopify and from companies that provide services to us, including payment processors, shipping carriers, fulfillment providers, vendors, manufacturers, advertising or analytics providers, and other companies involved in processing or supporting your transaction or interaction with Vertigo Home.
3. How We Use Personal Information
We may use personal information to operate our business and provide products and services to you, including to process and fulfill orders; process payments; arrange shipping and delivery; communicate about orders; provide customer service; manage customer accounts; process returns, refunds, cancellations, warranty claims, replacements, and store credits; coordinate Special Orders; prevent fraud and unauthorized transactions; verify transactions and protect our business and customers; maintain financial, tax, and accounting records; manage disputes and chargebacks; improve our Site, products, services, merchandising, and customer experience; analyze Site traffic and performance; remember customer preferences; provide marketing or advertising where permitted; comply with legal and regulatory obligations; enforce our Terms of Service and other policies; and establish, exercise, or defend legal claims.
We may also use information for other purposes that we disclose to you at the time the information is collected or with your consent.
4. How We Disclose Personal Information
We may disclose personal information when reasonably necessary to operate our business, complete transactions, provide services, or comply with legal obligations.
Shopify and Technology Providers
Our Site and ecommerce services are powered by Shopify. Shopify may process personal information in connection with hosting our store, checkout, customer accounts, payments, security, analytics, fraud prevention, personalization, and other Shopify services that we choose to use.
Shopify may process certain information under its own privacy terms and may provide consumers with privacy rights directly through Shopify. More information is available through the Shopify Privacy Policy and Shopify Privacy Portal.
Shopify Network Intelligence
We currently use Shopify Network Intelligence. When this feature is enabled, Shopify may use information about your interactions with our Site together with information from your interactions with other Shopify-powered stores and Shopify services to help provide and improve services such as analytics, personalization, advertising, and recommendations.
Depending on where you live, applicable law may give you the right to opt out of certain uses or sharing of personal information for targeted advertising or similar purposes. Where available, you may exercise those choices through the Your Privacy Choices, data-sharing opt-out, or similar privacy control provided on our Site. Shopify may also offer privacy choices directly through its own privacy tools.
Payment Providers
We may provide information to Shopify Payments or other payment providers necessary to authorize, process, secure, and document transactions.
Shipping and Fulfillment Providers
We may provide your name, shipping address, telephone number, email address, order information, and other necessary information to shipping carriers, freight companies, fulfillment providers, and logistics partners so that your order can be delivered.
Vendors, Manufacturers, Dealers, and Distributors
Some Vertigo Home products may ship directly from a manufacturer, dealer, distributor, or other vendor.
When necessary to fulfill an order, Special Order, replacement, repair, warranty claim, or other customer request, we may provide the applicable vendor or manufacturer with information reasonably necessary to complete that service, including your name, delivery address, telephone number, email address, order information, and relevant communications.
Service Providers
We may disclose information to companies that help us operate our business, such as website, cloud hosting, information technology, email, accounting, analytics, marketing, fraud prevention, security, and customer-service providers.
Professional and Legal Purposes
We may disclose information to accountants, attorneys, insurers, financial institutions, government agencies, law enforcement, courts, regulators, or other parties when reasonably necessary to comply with law, respond to legal process, protect our rights or property, investigate fraud or unlawful activity, enforce our agreements, or establish, exercise, or defend legal claims.
Business Transactions
If Vertigo Home or some or all of its assets are sold, transferred, financed, reorganized, or involved in a merger, acquisition, bankruptcy, or similar transaction, personal information may be disclosed or transferred as part of that transaction, subject to applicable law.
5. Cookies and Similar Technologies
Our Site and our service providers, including Shopify, may use cookies, pixels, tags, and similar technologies.
These technologies may be used to make the Site function properly; remember preferences and shopping-cart activity; authenticate customers; maintain security; understand how customers use the Site; measure Site and marketing performance; personalize content; and, where enabled, support advertising or marketing.
Some cookies are necessary for the Site to operate. Other cookies may be used for analytics, personalization, or advertising depending on our settings, your location, and your privacy choices.
Where available, you may manage certain cookie and tracking preferences through the privacy or cookie controls provided on our Site. You may also be able to control cookies through your browser. Blocking certain cookies may affect the operation or functionality of the Site.
6. Online Advertising, Sale, Sharing, and Targeted Advertising
Vertigo Home does not sell personal information in exchange for money.
However, certain privacy laws define terms such as “sale,” “sharing,” or “targeted advertising” broadly. Depending on the technologies and services used on our Site, providing identifiers or information about Site activity to advertising, analytics, or platform providers may be considered a sale, sharing, or processing for targeted advertising under some state privacy laws even when no money is exchanged for the information.
Where applicable, you may opt out of these activities through any Your Privacy Choices, Do Not Sell or Share My Personal Information, data-sharing opt-out, or similar privacy control displayed on our Site.
You may also contact us at info@vertigohome.us regarding a privacy request.
Where required by applicable law and supported through our Site's privacy settings, we recognize qualifying browser-based opt-out preference signals, such as Global Privacy Control (“GPC”), as a request to opt out of covered sale, sharing, or targeted-advertising activities for the browser or device sending the signal.
7. California Do Not Track Disclosure
Some web browsers offer a “Do Not Track” or “DNT” setting.
Because there is not a universally accepted technical standard governing traditional DNT signals, our Site may not respond to traditional DNT signals in the same manner across all browsers and services.
This is separate from legally recognized opt-out preference signals such as Global Privacy Control. Where applicable law requires us to recognize such a signal and our Site detects it through our privacy tools, we will process the signal as required by law.
Third-party analytics, advertising, ecommerce, or other service providers may collect information about your activity on our Site and, depending on their services and your privacy choices, may collect information about activity across other websites or services.
8. Marketing Communications
If you choose to receive marketing emails from Vertigo Home, we may use your contact information to send information about products, new arrivals, promotions, events, or other Vertigo Home news.
You may unsubscribe from marketing emails at any time by using the unsubscribe link included in the message.
Unsubscribing from marketing does not prevent us from sending non-marketing communications necessary to service an order, provide customer support, communicate about a warranty or return, or otherwise manage our business relationship with you.
If we offer SMS or text-message marketing, additional consent and opt-out instructions may apply to that service.
9. Data Retention
We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to complete transactions, provide customer service, maintain business and accounting records, administer warranties and returns, prevent fraud, resolve disputes and chargebacks, comply with tax and legal obligations, enforce our agreements, and protect our legal rights.
Different types of information may be retained for different periods depending on why the information was collected and applicable legal or operational requirements.
When information is no longer reasonably necessary, we may delete, anonymize, or otherwise dispose of it in accordance with our record-retention practices and applicable law.
10. Security
We use reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.
Our ecommerce platform, payment processors, and other service providers also maintain security measures for information processed through their systems.
No method of transmitting or storing information electronically can be guaranteed to be completely secure. We therefore cannot guarantee the absolute security of personal information.
11. Your Privacy Rights
Depending on where you live and the laws applicable to Vertigo Home, you may have certain rights regarding your personal information.
These may include the right to request information about the personal information we collect, use, or disclose; request access to or a copy of personal information; request correction of inaccurate personal information; request deletion of personal information, subject to applicable exceptions; request portability of certain information; opt out of certain sales, sharing, targeted advertising, or profiling activities where applicable; limit certain uses or disclosures of sensitive personal information where applicable; withdraw consent where processing is based on consent; appeal certain decisions regarding a privacy request where applicable; and exercise applicable privacy rights without unlawful discrimination or retaliation.
These rights are not absolute. Applicable law may permit or require us to retain or continue using certain information, including information needed to complete transactions, maintain business records, detect fraud, comply with legal obligations, resolve disputes, or exercise legal rights.
Submitting a Privacy Request
To submit a privacy request, email:
Please use “Privacy Request” in the subject line and describe the request you would like us to address.
We may need to verify your identity before fulfilling certain requests. We will use information provided for verification only as reasonably necessary to authenticate and process the request.
Where permitted by law, an authorized agent may make a request on your behalf. We may require evidence that the agent is authorized to act for you and may also ask you to verify your identity directly with us.
If applicable law provides a right to appeal our decision regarding a privacy request, you may submit an appeal by replying to our decision or emailing us with “Privacy Appeal” in the subject line.
If applicable law requires us to make an additional request method available, we will provide that method through our Site or another appropriate channel.
12. California Residents
California residents have privacy protections under California law.
The California Online Privacy Protection Act (“CalOPPA”) requires certain disclosures regarding the collection and use of personally identifiable information by commercial websites. This Privacy Policy is intended to describe our practices regarding the categories of information we collect, how we use it, categories of parties with whom it may be disclosed, and our online tracking practices.
California residents may also have additional rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”), when that law applies to a particular business or processing activity.
To the extent the CCPA/CPRA applies to Vertigo Home, California residents may exercise applicable rights described in the Your Privacy Rights section above, including applicable rights to know, access, correct, delete, and opt out of the sale or sharing of personal information.
Where required, we will also honor qualifying opt-out preference signals and provide any additional privacy choices or notices required by applicable California law.
We will not discriminate against a consumer for exercising an applicable privacy right.
13. Children’s Privacy
Our Site and services are intended for a general audience and are not directed to children under 13.
We do not knowingly collect personal information from children under 13 in a manner prohibited by applicable law. If you believe that a child has provided personal information to us improperly, please contact us at info@vertigohome.us so that we can review the matter and take appropriate action.
14. Third-Party Websites and Services
Our Site may contain links to websites, social-media platforms, payment services, or other third-party services that we do not own or control.
This Privacy Policy does not govern the privacy practices of those third parties. Their collection and use of your information is governed by their own privacy policies and terms. We encourage you to review those policies when interacting with third-party services.
15. International Visitors
Vertigo Home is based in the United States.
If you access our Site from outside the United States, your personal information may be transferred to, stored in, or processed in the United States or other countries where Shopify or our service providers operate.
Privacy and data-protection laws may differ between jurisdictions. Where applicable law provides additional rights regarding international transfers or the processing of personal information, we will address those rights as required.
16. Legal Requirements and Protection of Rights
We may collect, retain, use, or disclose personal information when reasonably necessary to comply with applicable laws, regulations, tax requirements, court orders, subpoenas, governmental requests, or other legal process.
We may also use or disclose information when reasonably necessary to prevent fraud, protect the safety or security of customers or others, protect Vertigo Home's property and legal rights, investigate violations of our policies, resolve disputes or chargebacks, or enforce our Terms of Service and other agreements.
17. Changes to This Privacy Policy
We may update this Privacy Policy periodically to reflect changes in our business practices, technology, service providers, legal requirements, or other operational reasons.
When we update the Privacy Policy, we will revise the Last Updated date at the top of this page.
If required by applicable law, we will provide additional notice of material changes.
We encourage you to review this Privacy Policy periodically.
